Terms of Service

These Terms of Service (“Terms”) govern your use of the havn.ai mobile application and website (together, the “Service”), operated by havn.ai (“we,” “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

The most important term, up front: havn.ai provides informational organization and analysis based on the documents you provide. It is not a law firm, licensed public adjuster, or insurance company and does not provide legal advice. Always confirm coverage, reimbursement, and strategy with your adjuster, a licensed public adjuster, or an attorney.

1. What the Service is

havn.ai helps you organize a property-insurance claim: storing and reading your documents, extracting information for your confirmation, tracking expenses, comparing estimates, answering questions grounded in your own documents, and generating report packets. Outputs of the Service — including AI-generated summaries, extractions, comparisons, and answers — are informational tools to help you get organized. They may contain errors, they depend on the documents you provide, and they are not professional advice of any kind. You are responsible for verifying information before relying on it, and decisions about your claim are yours.

2. Eligibility and accounts

You must be at least 18 years old to use the Service.
You agree to provide accurate account information and to keep access to your sign-in email secure. You are responsible for activity under your account.
One person per account; you may invite others to view or contribute to a claim through the features the Service provides.

3. Your content

You own your content. Documents, photos, and information you upload or enter remain yours.
You grant us a limited license to host, process, and display your content solely to provide the Service to you — including sending relevant portions to our service providers (for example, AI and OCR processing) as described in the Privacy Policy.
You are responsible for having the right to upload the content you upload.
You can delete a claim (including its documents) at any time; deletion is permanent.

4. Acceptable use

You agree not to:

Use the Service to commit insurance fraud or to misrepresent facts to any insurer, adjuster, or court — havn.ai is for organizing truthful claims, not manufacturing them;
Upload malware, attempt to access other users' data, probe or overload the Service, or circumvent usage limits;
Resell or white-label the Service without a written agreement with us;
Use the Service in violation of applicable law.

5. Beta status, availability, and changes

The Service is currently offered as a beta. Features may change, be added, or be removed; availability is not guaranteed; and data limits (such as document, message, or report caps) may apply and change. We'll communicate material changes in the app. We may suspend or terminate accounts that violate these Terms.

6. Fees

The Service is free during the beta. We expect to introduce paid plans (such as subscriptions or one-time claim passes). If we do, pricing and terms will be presented clearly before you are charged, and paid features purchased through an app store are also subject to that store's terms.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE ABOVE: HAVN.AI DOES NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE OR COMPLETE, DOES NOT GUARANTEE ANY CLAIM OUTCOME OR REIMBURSEMENT, AND DOES NOT PROVIDE LEGAL, FINANCIAL, OR INSURANCE ADVICE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAVN.AI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR CLAIM OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnity

You agree to indemnify havn.ai against claims arising from your violation of these Terms or your misuse of the Service, including any misrepresentation you make to an insurer using materials you prepared with the Service.

10. Termination

You can stop using the Service and delete your data at any time. We may suspend or terminate access for violations of these Terms, with notice where practicable. Sections that by their nature should survive termination (including 7–9) survive.

11. Changes to these Terms

If we make material changes, we will update the effective date above and notify you in the app or by email before the changes take effect. Continued use after changes take effect constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the United States and the state of havn.ai's principal place of business, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at info@myhavn.ai and give us 30 days to work it out informally.
